Terms of service

These terms of use (hereinafter referred to as "these terms") stipulate the terms of use of the services (hereinafter referred to as "this service") provided by PEOPLE Co., Ltd. (hereinafter referred to as "our company") on this website. Users who register (hereinafter referred to as "users") must use this service in accordance with these terms.

Article 1 (Application)

1. These terms apply to all relationships between users and our company regarding use of this service.

2. In addition to these terms, our company may establish separate rules for using the service (hereinafter referred to as "separate terms"). Regardless of the name, these separate terms constitute part of these terms.

3. If there is any discrepancy between the provisions of these terms and those of the separate terms, the provisions of the separate terms shall take precedence unless otherwise specified in the separate terms.

Article 2 (User Registration)

1. To register to use this service, applicants must agree to these terms and apply for registration using the method specified by our company, and registration is completed when our company approves the application.

2. Our company may choose not to approve a registration application if we determine the applicant falls under any of the following. In such cases, we have no obligation to disclose the reason for disapproving the application.

(1) The applicant has provided false information when applying for registration.

(2) The application is from a person who has violated these terms in the past.

(3) Any other case where our company deems registration inappropriate.

Article 3 (Management of User ID and Password)

1. Users are responsible for appropriately managing the user ID and password for this service.

2. Under no circumstances may users transfer or lend their user ID and password to or share them with a third party. Our company considers any login using a combination of user ID and password matching the registered information to be use by the registered user of that user ID.

3. Our company is not liable for any damage caused by unauthorized use of a user's ID or password, except where we are guilty of intentional misconduct or gross negligence.

Article 4 (Usage Fees and Payment Methods)

1. To pay for paid portions of this service, users must pay the usage fees specified separately by our company and displayed on this website using the method specified by our company.

2. If users are delinquent in paying usage fees, they must pay a late charge at an annual rate of 14.6%.

Article 5 (Prohibited Acts)

Users must not engage in any of the following acts when using this service:

1. Acts that violate laws and regulations or public order and morals

2. Acts related to criminal activity

3. Infringement of copyrights, trademarks, and other intellectual property rights contained in this service

4. Destroying or obstructing the functions of servers or networks of our company, other users, or third parties

5. Using information obtained through this service for commercial purposes

6. Acts that may interfere with operation of our services

7. Unauthorized access to services or attempting to gain unauthorized access

8. Collecting or storing personal information about other users

9. Using this service for improper purposes

10. Causing disadvantage, damage or discomfort to other users or third parties

11. Impersonating other users

12. Advertising, promotional activities, solicitation, or commercial activities on this service without permission from our company

13. Acts for the purpose of meeting unacquainted persons of the opposite sex

14. Providing benefits directly or indirectly to anti-social forces in connection with our services

15. Any other act our company deems inappropriate

Article 6 (Suspension of Service Provision)

1. Our company may suspend or interrupt all or part of this service without prior notice to users if we determine any of the following circumstances exist:

(1) Maintenance, inspection or updating of computer systems related to this service

(2) Difficulty in providing services due to force majeure such as earthquakes, lightning, fire, blackout or natural disaster

(3) Malfunction of computers or communication lines, etc.

(4) Any other case where our company determines provision of services is difficult

2. Our company is not liable in any way for any disadvantage or damage users or third parties may incur due to suspension or interruption of services.

Article 7 (Service Restrictions and Deregistration)

1. Our company may restrict all or part of service use by users or delete user registrations without prior notice if we determine users fall under any of the following.

(1) Violation of any provision of these terms

(2) False information found in registered data

(3) Failure to pay usage fees or other debts

(4) No response to contact from our company over a certain period

(5) No service use for a certain period after the most recent use

(6) Any other case where our company deems use of this service inappropriate

2. Our company is not liable in any way for damage incurred by users as a result of measures taken by our company under this article.

Article 8 (Withdrawal)

Users may withdraw from this service by following the withdrawal procedure specified by our company.

Article 9 (Disclaimer and Limitation of Liability)

1. Our company expressly disclaims any and all warranties, express or implied, regarding this service being free of defects, errors or bugs, and regarding safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, and non-infringement.

2. Except where caused by our intentional misconduct or gross negligence, our company is not liable in any way for any damage incurred by users arising out of this service. However, this limitation of liability does not apply when the contract between our company and users regarding this service (including these terms) falls under a consumer contract as defined in the Consumer Contract Act.

3. In cases pursuant to the preceding paragraph, our company is not liable in any way for damages incurred by users as a result of our slight negligence that are extenuating circumstances (including cases where the occurrence of damages was foreseeable by our company or users), and the maximum liability for damages incurred by users due to our slight negligence shall be the amount received from the user as usage fees in the month the damages occurred.

4. Our company is not liable in any way for transactions, communications or disputes occurring between users and other users or third parties regarding this service.

Article 10 (Changes to Services)

Our company may change, add or delete service content by notifying users in advance, and users are deemed to consent to this.

Article 11 (Changes to Terms of Use)

1. Our company may change these terms without individual consent from users in the following cases:

(1) When the changes to the terms are beneficial to general users

(2) When the changes do not violate the purpose of the service contract and are reasonable in light of the necessity of the changes, the post-change details, and other circumstances regarding the changes

2. When changing these terms pursuant to the preceding paragraph, we will notify users in advance of the changes, the content of the revised terms, and the effective date.

Article 12 (Handling of Personal Information)

Our company will handle personal information acquired through use of this service appropriately in accordance with our "Privacy Policy."

Article 13 (Notifications and Contact)

Notifications and contact between our company and users will be made using methods specified by our company. Unless we receive a change notification from the user using the method specified separately by our company, contact information currently registered is deemed valid, and notifications and contact to the registered contact point are deemed to have reached the user at the time of transmission.

Article 14 (Prohibition on Transfer of Rights and Obligations)

Without obtaining our company's written consent in advance, users may not transfer or offer as collateral their status under the terms or any rights or obligations under these terms to a third party.

Article 15 (Governing Law and Court of Jurisdiction)

1. The interpretation of these terms is governed by Japanese law.

2. Any disputes arising regarding this service will be subject to the exclusive jurisdiction of the courts with jurisdiction over our company's head office location.
